In the case of GW Topham & Son, the farm business was fined £400,000 for breaching Health and Safety and Provision and Use of Work Equipment Regulations when a 19-year-old tragically died from multiple injuries when the tractor and trailer he was driving struck a bridge. An investigation by the HSE found that the trailer on the tractor he was driving was fitted with drum-type brakes that had not been correctly adjusted, rendering them ineffective.
The business was found guilty of failing to implement and monitor safe systems of work in managing the risks involved.
The HSE determined that the death was preventable if the employer had ensured all work equipment was properly maintained.
